Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the GrowthGenie platform (“Service”), operated by 41510.io LLC (“41510.io,” “we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. Questions: scott.kaplan@41510.io.

1. Description of Service

41510.io provides GrowthGenie, a performance optimization platform for marketing agencies and performance marketing teams. The Service connects to your advertising accounts (currently Google Ads) via OAuth, retrieves performance data, analyzes it, and delivers performance intelligence, recommendations, and optional user-approved actions.

Current features include Leadership View (executive performance briefings), Deep Diver (driver decomposition analysis), and Budget Optimizer (budget recommendations). Features may be added, modified, or removed at our discretion.

GrowthGenie is a business-to-business platform. Access requires an invitation from an authorized administrator. Consumer use is not supported.

2. Accounts and Access

Access to GrowthGenie is by invitation only. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at scott.kaplan@41510.io if you suspect unauthorized access.

You represent that you are authorized to connect the advertising accounts you link to GrowthGenie and that doing so does not violate any agreement with a third party.

3. Google Ads Integration and Authorized Use

By connecting your Google Ads account to GrowthGenie, you authorize us to access your Google Ads data using the Google Ads API. This access is used to:

Retrieve campaign, ad group, and account-level performance metrics;
Generate intelligence summaries, pacing calculations, and driver analyses;
Apply budget changes to your Google Ads campaigns that you have explicitly reviewed and approved within the GrowthGenie platform.

GrowthGenie will not apply any change to your Google Ads account without explicit user approval. Budget Optimizer recommendations are proposals only; you must review and confirm each recommendation before any change is executed. You may disconnect your Google Ads account at any time, after which stored credentials are permanently deleted from our systems.

Our use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.

4. User Responsibility for Budget and Ad Spend

You are solely responsible for all budget configurations, spend limits, automated rules, and actions you configure or approve within GrowthGenie. GrowthGenie acts as an execution tool on your behalf. When you approve a recommendation, you are directing GrowthGenie to carry out that instruction using your authorized credentials, and you accept full responsibility for the outcomes, including any ad spend incurred.

GrowthGenie is not liable for ad spend overages, campaign underperformance, missed goals, or any financial outcomes resulting from configurations you authorize or recommendations you approve. You are responsible for reviewing all recommendations before approving them.

5. Subscriptions, Trials, and Payment

The Service is offered on a subscription basis. Subscriptions automatically renew at the end of each billing period unless cancelled. We offer a free trial; at the end of the trial period, your account will not be charged and will be suspended until you upgrade to a paid plan. Payments are processed in US dollars. You may cancel at any time by logging into your account or contacting customer service.

6. Acceptable Use

You agree not to:

Access advertising accounts for which you do not have authorization;
Reverse engineer, decompile, or extract GrowthGenie’s proprietary methodology, models, or algorithms;
Use the Service in any way that violates applicable laws or Google Ads policies;
Resell, sublicense, or redistribute access without written authorization;
Probe, scan, or test the vulnerability of our systems or circumvent security measures;
Use the Service to harm, harass, or defraud others.

We may suspend or terminate accounts that violate these Terms without notice.

7. Intellectual Property

GrowthGenie and its underlying technology — including our performance framework, decomposition methodology, recommendation engine, prompt design, and software code — are the exclusive intellectual property of 41510.io. Nothing in these Terms transfers any intellectual property rights to you. You retain ownership of your advertising performance data, and by using the Service you grant us a limited license to process that data solely to provide the features described in these Terms.

8. Limitation of Liability

To the fullest extent permitted by law, 41510.io and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, profits, or ad spend resulting from performance recommendations or approved actions; service interruptions or data inaccuracies caused by third-party platforms; performance fluctuations or policy changes by Google or other ad networks; or loss of data due to events outside our reasonable control.

In no event shall our total liability for all claims arising out of or related to the Service exceed the lesser of the total fees you paid to us in the six (6) months preceding the claim, or one hundred US dollars ($100).

9. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted or error-free, that recommendations will achieve any specific outcome, that data retrieved from third-party APIs will be accurate or complete, or that AI-generated summaries will be free of errors. Performance intelligence provided by GrowthGenie is informational only; you are responsible for independently verifying recommendations before acting on them.

10. Third-Party Services

The Service integrates with third-party platforms including Google Ads, Google Cloud Platform, Anthropic, OpenAI, and others. We have no control over the availability, accuracy, or continuity of these services, and are not liable for any impacts caused by their downtime, API changes, or policy modifications. Your use of Google Ads through GrowthGenie is also subject to Google’s own terms and policies.

11. Confidentiality

We treat your advertising data, performance metrics, and business intelligence as confidential and do not disclose client-specific data to competitors or third parties except as described in our Privacy Policy. You agree to treat any proprietary methodology or non-public feature information shared with you as confidential.

12. Term and Termination

Either party may terminate access to the Service at any time. Upon termination, your access will be suspended, stored OAuth credentials will be deleted in accordance with our Privacy Policy, and you may request an export of your raw performance data within 30 days. We may terminate or suspend access immediately if you violate these Terms or engage in fraudulent or harmful activity.

13. Dispute Resolution

In the event of a dispute, the parties agree to first attempt to resolve it through informal negotiations for at least thirty (30) days. If unresolved, the dispute shall be settled by binding arbitration in the State of California, United States. Where excessive, we agree to pay arbitration fees. This does not prevent either party from seeking injunctive relief where appropriate.

14. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

15. Changes to These Terms

We may update these Terms from time to time. The updated version will be indicated by a revised “Last updated” date. For material changes, we will notify you by email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
